MY FIRST LETTER

Dear Sir,

It is with regret and much sadness that I had to record a formal complaint against one of our members. This formal complaint was made to the duty committee member and recorded.

The incidents happened on the evening of Saturday 25th. September and concern the conduct of Mr.Johnston. (I am not sure of the correct spelling of his name).

There was an altercation between Mr.Johnston and a friend with whom I sit, Bob. As a consequence of the altercation, and the conduct of Mr.Johnston near my table, I was abused and physically assaulted by Mr.Johnston.

I attach a summary of the incident.

I explained to the duty committee member that I preferred that the matter be dealt with on an informal basis by the committee and I still prefer this. If after considering the case the committee decide that the matter has to be resolved formally then I will need copies of the following documents in order to prepare my case.

1. Articles of Association of the company limited by guarantee and any attachments or addenda.

2. Rule book and any documents relating to the conduct of members and duty committee member.

3. Entries in the Duty Log Book of similar incidents over the past year.

4. Disciplinary procedure.

5. Appeals procedure.

6. Procedure for obtaining assistance from head office in support of my action.

7. Any other documents and statements made to the committee in its investigation of this complaint.

There were at least four other committee members present and their views may clarify the situation.

I repeat, I would prefer that this matter be concluded with the minimum of fuss and formality, and look forward to receiving a note from the committee assuring me that this has been done.

MY FOLLOW UP LETTER

Dear Sir,

I refer to my letter of 26/09/99. I enclose a copy as the original may have been addressed incorrectly to the Branch rather than the Club.

I attended the club last night, Tuesday 28th.

I understand that the matters surrounding my complaint were discussed. Therefore, I must assume that all connected matters are to be dealt with formally.

Please let me have the copies of documents itemised in my letter of 26/09/99, together with a copy of the minutes of the meeting held on 28/09/99, and advise me of the date for the hearing of my complaint.

Enclosed is my cheque for £5 to defray any expenses. Any excess may be put to the club funds or I will settle any additional expense as advised.

Please confirm receipt of the two letters. A SAE is enclosed for your convenience.

MY FURTHER LETTER TO THE CLUB

Dear Sir,

I attach a letter in which Mr. Stephens requests that I represent him at his disciplinary hearing.

I have not yet decided whether I wish to be represented at the hearing of my allegation of threatening behaviour and actual assault by Mr.Johnston.

As my allegation is of a very serious nature, and may take some time to hear, I respectfully suggest that a special disciplinary committee meeting be convened in order to hear Mr.Johnston's case and mine. I estimate that the hearings will take between one and two hours. It is unlikely that all involved will be able to present their cases before the time of the next committee meeting.

It will be necessary for me to call witnesses and have statements taken. As I do not yet have any documents to which I can refer regarding, the correct procedures, I would be very obliged if the items that I requested in my letters of the 26th. & 29th. September could be sent to me as soon as possible.

May I also suggest that if we have an almoner (adjutant type) that we seek his/her advice on these matters?
